The UPP has signed an agreement with a consumer mediator on your behalf.

We told you about it a few weeks ago here: Since January 1, 2016, any professional photographer dealing with (non-professional) consumers has been obliged to offer them the option of consumer mediation, an out-of-court dispute settlement process.

1. who is affected?

Any photographer who has commercial contact with private individuals or similar (certain groups, associations, companies outside their core business...).

This means that if

- You sell photographs to collectors,

- Your customers are private individuals or similar for

print sales,

exhibition booklets,

benefits of any kind,

Then you need a consumer ombudsman.

NB: This obligation exists even before the first sale, as soon as you address a private customer base.

2. What do you need to do?

To meet these obligations, you must

- enter into an agreement with a consumer mediator,

- enabling consumers to use mediation

informing them of the system

by communicating the contact details of your ombudsman on your website, in your General Terms and Conditions, on your order forms, on your contracts and by any other appropriate means.

NB: Failure to comply with these obligations is punishable by an administrative fine of 3,000 euros for an individual and 15,000 euros for a legal entity.

3. Good news: you're covered by UPP

Access to mediation can be gained on an individual basis or through membership of a professional organization.

To support you in your professional practice, the UPP has taken the initiative of negotiating and signing a framework agreement with an accredited consumer mediator.

From now on, if you are a UPP member, you are covered by this framework agreement and have access to the mediation service set up by celle-ci for the benefit of UPP members.
